so the house i live in we rent from someone in town, its a thousand dollars a month, and its a nice house with a fenced in backyard, i like it and it works out great....

problem is the land lord just called and said the house might be sold at auction if the lawyers cant settle on something, turns out the landlord has not been paying the morgage while the previous renter was here and only picked up making payments since i moved in, problem is I have no contract because i know the ppl that rent (edit: and now the house is going to auction tomorrow...)

FML and i just found out tonight

Start checking state, and local laws, you can probably buy yourself 3 to 6 months if you can prove that you are currently living there. But without a lease you sound pretty fucked.

If the sale goes through it will probably be a week to 2 months before the new owner is ready to take over the property, pretty sure they cant kick you out right away, but depending on your local laws they might not have to give you much notice at all

with no contract for you or probably the enw buyers, you could be tossed out in as little as 24 hrs. auction sales are usually immediate. no closing time and all that jazz.

i would agree with above new owner may hope to keep the renters in place.

in todays econ you may get lucky and it won't sell. we've had one here go to auction 3 times and it hasn't sold yet. depends if they go absolute auction or reserve. absolute now days and you stand a very good chance of taking a bad bath on real estate.

Exactly! You may not even have to move but you will probably have to sign a lease if it goes this way.

I would expect 30 days though if you do get the boot.

Yeah Ive heard that renters get 30 days to move in this situation, but I dont know if that applies when you dont have a contract.

More than likely the bank will bid it in at auction. If that is the case, you will be able to keep renting and pay rent to the bank while they try to sell it. In this economy, you may have a while. Either way, you should be looking for something immediately.

This shit is happening everywhere. Landlords not using rent to make the payments. I've been involved in several recently.

last house i rented, kids couldnt pay the bills and house got foreclosed. it was a damn good thing i was already looking to buy one of my own, or it could have been really ugly. I have been screwed from rentals from private people to huge mega corp rental entities in large apartment complexes. nobody is safe unless you own.

you are pretty much screwed , unless you refuse to leave and become a squatter like the fucks across the street from my house.... possession is 9/10's the law, and the law seems to favor squatters...

Hard to say, if you're living there you're in some form of implied contract. You could be a dick and refuse to leave, then they would have to evict you legally..

Or, they could come in and throw your shit in the street and say GTFO!

hold out as long as you need, but start looking now. by the time the first eviction note shows up , you usually can draw it out for 3 months.

Leases roll over, the new owner has to abide by it unless they buy you out. If you're in a month-to-month, you get 90 days to leave. Problem is, there will likely be no maintenance performed if the bank takes it. Personally I'd just quit paying rent and invest in a storage unit, but you're legally entitled to a roof over your head for the duration of the lease you signed.

Didnt sign a lease according to the thread. My bank just went thru all this with a rental we foreclosed on. I begged the tenats to sign a lease to the bank but they didn't, now the property has sold and they have 30 days to get out...

Call the auction place and ask about "Cash for Keys" - it's usually around $2000 relocation assistance and in return you get ALL your stuff out and leave it broom clean in a certain amount of time.

Just because it's gone to auction doesn't mean you have to be OUT of there by tomorrow.
You have options, just not as many as you had yesterday

Where's the auction, and what's the opening bid? Around here, the banks can't use the house as an asset, and like to get at least 40 percent of the loan value. Maybe you can deal or get a friend or relative to bid.
