California Gov. Signs Bill vs. Aftermarket Pipes

California Gov. Arnold Schwarzenegger signed Senate Bill 435 yesterday that will authorize state law enforcement to ticket motorcyclists who have swapped out their stock pipes for non-EPA-approved aftermarket exhaust. The new law will make it a crime to operate a motorcycle manufactured after January 1, 2013, that does not meet federal noise-emission standards. Motorcycles will be required to display a U.S. Environmental Protection Agency (EPA) label certifying that the exhaust system is clean burning and does not exceed 80 decibels. First-time offenders will face fines up to $100 while subsequent infractions can run up to $250.
The bill is meant to target motorcyclists who remove federally mandated, factory-installed emission control devices and replace them with custom aftermarket parts. Aftermarket pipes generally increase power output, but they are also usually louder and less environmental-friendly. The EPA’s position states that the legislation is “aimed at quieting the deafening roar of modified rides and at reducing emissions.”
The bill was proposed by Sen. Fran Pavley, D-Agoura Hills, who claims that residents in her district have complained about the noise from motorcyclists who enjoy riding through the twisting roads and canyons of Malibu, Calabasas and Agoura Hills.
California has 826,000 registered motorcycles. How this will affect motorcycle dealerships, aftermarket suppliers, custom motorcycle builders and motorcycling tourism is up to speculation.
Companies like Cobra USA, who makes high performance motorcycle exhausts and is based in Yorba Linda, California, said it will take a pro-active approach to the situation and will work with local governments and entities like the Motorcycle Industry Council to make a more “responsible pipe.”
Schwarzenegger, the man who signed the legislation into law, ironically is an avid motorcyclist who reportedly has a collection of motorcycles and has been known to frequent the same Malibu hills Pavley says her complaints come from. Whether his motorcycles meet federal noise requirements is unknown.
The times, they are a-changin'. Used to be the rally cry was “Loud Pipes Save Lives.” Nowadays, though, it’s “Loud Pipes Risk Rights.”

All this will do is depress sales of 2013 bikes........Everyone else will search for a 2012 or just hold onto what they've got. It would have been more fair to the OEM's to require EVERYONE to put their stock exhaust back on.

It doesn't hurt OEM's.
Do OEM's make bikes that are less than 80db? I actually would support this, but 80db seems kinda quiet, 95 or 100db would be mo0re reasonable

My fucking 1300cc bus says 80db.. shit is way too quiet.. Think 108db will draw attention? :rockwoot:

i thought for sure this thing wouldnt pass, the governator being a biker supposedly, and he's on his way out. kinda like a big "screw u" cali bikers.
so...does that mean that theres no db limit on 2012 and older bikes?

The law says that you have to display the EPA Noise Pollution Label of 80db, not that it has to be 80 db. So you just take the label off of the OEM can and put it on ur D&Dredflip Problem solved.

It would hurt them because which bike would you buy, a 2012 or a 2013? Simple.
And fewer new riders are going to be interested in becoming riders after 2013, if they know bikes can't be modified. Unless they want to keep buying old bikes.

What the hell do noise levels have to do with the EPA?
What about air horns? 18 wheeler engine braking? Gun shots? Live music? Or the million other things that are way over 80db?

Thank you very much!!! Someone who actually read the law instead of posting knee-jerk reactions.
It ain't gonna affect the aftermarketers any either. Leo Vince and a host of other aftermarket exhaust companies already put out Euro stamped compliance exhausts. All they have to do is revise their tooling to stamp USDOT compliance stamp on the exhausts as well. You take the shit home, yank out the dB-killer inserts just like you do now. Done. Finito. End of story.
It was a stupid law that really means nothing. If anything, it allows people with aftermarket pipes to run the shit loud. "Hey, officer, here's the stamp showing that it's DOT noise compliant. I don't know why it's loud."
How many cops would know about dB-killer inserts?
Right now cops can bust you with fix-it tickets for just having non-factory pipes.

True...but only for a year or two. And most people aren't going to know the law anyway.
People now can be ticketed for aftermarket exhaust so in reality there is no difference other than the cops can pull you over to check for a correct label.

Your missing the point Hans. The reason this law is bad is because NOW cops can simply pull you over to CHECK for the label. They can already pull you over for loud exhaust, so the MY is not relevant.

They could have done that before too , if they suspected it was aftermarket. They just rarely ever did it.
