I figured this article would pass muster here. Big companies shouldn't be hated on unless they're Apple. :lol:

NEW YORK (Reuters) - Apple Inc. Chief Executive Steve Jobs, who is out on medical leave, has been ordered by a federal magistrate to answer questions from plaintiffs' lawyers in an antitrust lawsuit related to his company's iTunes business.
U.S. Magistrate Judge Howard Lloyd, based in San Jose, California, ruled that lawyers representing the plaintiffs in the suit may question Jobs for a total of two hours. He issued the ruling on Monday.
Apple could appeal the ruling to a district judge, but it would likely have to make a case that the magistrate "made a big mistake," said Professor David Levine at University of California Hastings College of the Law.
An Apple spokeswoman declined to comment, and attorneys for the plaintiffs did not respond to requests for comment.
In the class-action lawsuit, a group of consumers say Apple created a music-downloading monopoly with its iPod player and iTunes store. At issue is a piece of software called Fairplay that allowed only music bought on iTunes to be played on the iPod, according to the complaint.
One competitor, RealNetworks Inc, responded in 2004 by introducing a new technology that would allow customers to play music downloaded from its site on their iPods. Apple quickly announced a software upgrade to iTunes that once more blocked music from RealNetworks, the complaint charges.
"The court finds that Jobs has unique, non-repetitive, first hand knowledge about Apple's software updates in October 2004 that rendered the RealNetworks's digital music files once again inoperable with iPods," Lloyd wrote in his ruling.
The ruling comes amid intense questions about Jobs' health and whereabouts. Earlier this month an energetic but thin Jobs resurfaced to unveil Apple's new iPad. His appearance helped reassure investors and fans worried about what his absence might mean for the company.
Apple failed to provide specific examples of how a deposition of Jobs would constitute "undue hardship," the plaintiffs wrote in a court filing last December.
Lloyd said the deposition of Jobs would be limited to questions about the back-and-forth with RealNetworks in 2004. Apple had sought to prevent the deposition altogether, while the plaintiffs asked to be allowed a broader inquiry.
"By limiting the scope of the deposition, the judge is trying to avoid using this as some sort of tool for embarrassment or annoyance," Levine said.
Should a district judge uphold Lloyd's ruling, Levine said it would be extremely difficult for either side to appeal further.
The case is in re Apple iPod iTunes antitrust litigation, Case No. 05-00037, U.S. District Court, Northern District of California.
Apple is involved in a host of other lawsuits, both as a plaintiff and defendant, ranging from disputes over patents to antitrust allegations. On Monday, Apple sued Amazon.com Inc in a bid to stop the online retailer from improperly using its APP STORE trademark, according to a court filing.

So they weren't able to convince the Judge that Jobs medical condition was serious enough that he could not answer a couple of questions? Or was it a timing issue?
I personally think the lawsuit should be chucked out the window.

Real is a crappy company that makes crappy bloated software, but (If I remember correctly) the software they created for their music was in full compliance with Apples end user agreement at the time, and fit within all the rules and laws that apple and the gov had at the time. The software update included a change to the end user agreement that made the 3rd party music against the rules. The real dispute (again I could be wrong) is that all apple products sold prior to ther change should have been exempt from the software update.
Anyway, if you want to put other 3rd party music in the ipod, just unhide folders and put the damn music in.

I just fixed a touch for vic last night. A factory reset bricked the fucking thing. Apparently itunes is required to start one. Fine, np, oops errors everywhere. Had to blow an hour reading through thread after thread of moronic itards who had a similar issue and just bought a new one before I found the double secret button combo to put it in a restorable state. Shit company, shit software, shit product. Hope jobs gets aids

Problem is that there really isnt any mp3 player out there that is as good as the ipod is. Apple really did do something good when they designed it and through improvements through the years. Zune came close, but never really caught on. So instead we are all stuck with ipods

Problem is that there really isnt any mp3 player out there that is as good as the ipod is. Apple really did do something good when they designed it and through improvements through the years. Zune came close, but never really caught on. So instead we are all stuck with ipods
unless you are using a shuffle/new nano, I don't see the point when you have an Android phone.
Doubletwist will even make it itunes friendly if you want to fuck with itunes.

Have had a gen 1 zune for 5 years now. I've beat the ever living hell out of it, and I've had 5 problem free years. I think I have dropped it on every surface I can imagine, been down a flight of stairs 3 times, and into a puddle twice. Starts up and plays just like the day I bought it. That's the kind of product that will make me a customer for life.
The same can't be said for the countless friends who have had multiple ipods shit out on them, almost like they have a planed life cycle. Hmmmm..... :lol:

This. I've gone through a couple of ipods that crap out for no god damn fucking reason at all. Zune still chugs along. I know I can dump all my music on my X, but I like having a separate mp3 player.

I have heard good things about the Archos 43. I might check one out. I have a Creative Zen which I like but I want much more memory then the 8 gb I have now.
IMO the only thing(s) Ipods have is the aftermarket support and the connection. The location of the connector and the type allows the use of the dock. This will also charge it which is good and bad. Some people don't want the battery being charged all the time. Those are the only real benefits I see with the Ipod.
I don't think Ipods are bad (priced too high but anyway) but I don't think they are THAT good.

I lost the shuffle, the gen 5 worked great until I started to need something smaller which is why I bought the nano, and now I cant seem to find the gen 5, and now the nano which I destroyed in the washing machine and dryer. Overall it is a very user friendly product, and pretty durable.
Really what I see the ipods have over the competition is the memory size, and ease of use of the actual music player. Itunes software is a whole nother story all together, it blows donkey balls.
I also include in my assessment the aftermarket support of a product.

When I was looking for an MP3 player I thought about it for a second, but my Zen had the same memory and half the price. It also has a radio which the Ipod of the time didn't have (I don't like the radio so I it doesn't matter but its a feature that the Ipod of the time didn't have. And it worked well.)
And its no harder to use then an Ipod. And as far as Ipods being easy to use I don't feel they are that easy until you are shown how to use them. I sold electronics an people didn't seem to know how to use them without a demo. The Touch is a little better.
As far as memory my Zen has an SD slot so I can upgrade the memory. The only problem is I have to check it on its own. It just won't see all music/pictures/videos. If I knew this I would have bought the Zen with the larger drive. Now on the Archos 43 it has and SD slot that the player read on its own. If you look at your music it will show you whats on the card and on the drive. This is something that you can't get with an Apple product and I'm willing to bet that you might not ever be able to.
What Apple has is the after market support. You get Ipod pockets in yoga pants, docks, cases and so on. Other mp3 players are hurting when it comes to after market products.
I don't really like the Android but I think it has a chance to hurt Apple. So many companies are using it. If enough companies start using it they should move to a standard Ipod like connection. That would allow a dock to be made that would support multiple players. This could help them and hurt Apple.
As far as Itunes goes that is a pain in the ass. I have used it a bit and I don't like the program at all. What I do like is the ease of buying music on the Iphone/Touch if you do buy music. My sister likes to get Itunes cards as gifts and every now and then she will buy some old song we were talking about. But with that said we can also just jump on Youtube on them or on my Blackberry and play the song there. But that is one good thing I can say about Itunes.

Oh one thing I LOVE about the Ipod Touch is the kinda Jukebox view of of the music. The one with the Album/CD covers. The Archos 43 has something like this, I haven't tried it but from picture it looks like the next best thing. I still like the way the Ipod Touch does it but the Archos is a step in the right direction I think.

I totally agree that the standalone mp3 player is on its way out, problem with android is that I havnt found a music player that I really like yet.
I tried mixzing, but most of my music is obtained through other sources and not labeled correctly, it played some music but left whole albums off.
Cubed was buggy and would play whole genres of music when I asked for a specific song
Merdian is good but I had to force close constantly, and when it did work, it kept turning my screen on leaving me with at most 2 hours of battery life
If anyone knows an easy to use and stable android music player I would be grateful. I am planning on a new phone sometime this month, gonna get a 32gb sd card so I can keep a decent amount of music on it. I would like to be able to hook my phone up to a BT helmet set like the sena that trip reccomends

Cyanogen made my phone freeze. I have one of the weaker android based phones out there now. It was a mid grade phone a year and a half ago when I got it, its crap now.
I use Winamp on my Droid X. So far so good. The shoutcast streaming is an added bonus.

Me too. The ex bought me one 5 or 6 years ago. Use it riding and used to run with it until I bought my iPhone. Its just now starting to lose battery life.

So should the lawsuits against Microsoft have been tossed out the Windows(tm) too? Funny how people generally get down on "the evil empire", but give Jobs a pass for the same predatory business practices.

I have a 2nd gen lying around somewhere, but its battery only lasts 3 hours at best..........and that was after getting a new one under "warranty". The same was true for everyone else I knew who had one of those.

I've lost count of the number of times I've heard about RIM (Blackberry) suing someone, or being sued, over 'proprietary technology.'

I suspect unintentional, though Apple will probably assert otherwise. "There's an App (Apple) for that" doesn't make much sense when referring to software.
