But eventually I'm sure they will slip the verbage into there user agreement and people wont even know the goddamn difference.

I'm not on Instagram. You might be surprised how many sharing services have similar terms of service. There has to be SOMETHING similar to that in the agreement, or they can't reproduce your images to share them. It's just that some services take things too far with the language and it sets off the users.
