So I found a good deal on a pair of brand new basketball shoes as a buy it now on ebay last tuesday. I jumped on them and paid for them immediately following with my paypal account. I then got a message from the seller that read

Dear joed1340,

Thank you for the purchase and quick payment, you
will not believe what I am about to tell you. I
went to ship your shoe today and I accidently
dropped my ball point pen on the tip. There are 2
small marks on the shoe now. I can do 1 of 2
things. Issue you a complete refund or issue you
a partial refund of $10 and ship the shoes still.
Let me know what you would want me to do. I can
provide a picture if you are interested. But I
measured it, it is about 2 small marks and 1 is
about 1cm and 1 is about 1.5cm, it is where the
laces end.

I received that last thursday or friday and nformed him to just credit me the $10 and send them anyway. I sent him a second message since I got no response when I noticed that he is no longer a registered ebay user. So I sent an email demanding some sort of answers today to the actual website that the seller was from and have yet to hear back. The seller has over 3k feedback and over 98% positive.

What would you do in this situation? I want to give them a little time because I did notice that a couple of the negative feedbacks were slow communication, but I dont want to get screwed. Should I just go ahead and file a complaint? If so should I go through ebay or through paypal? Any suggestions?

I'd file a complaint with ebay if he's no longer registered. Then I'd file with paypal to get my money back if ebay didn't refund it for me.

Thats what I was thinking. Have you ever had to do that? This is the first real issue Ive had with anything Ive bought on there.

im bout to have to do that with a marker i ordered last week. won with buy it now, paid that night and talked to the guy on the phone the next day and havent heard shit since. that was the 17th

Yeah, you can actually do that now. I was going to do it last night with mine but theres a 10 day waiting period so I have to wait until friday before I can file a complaint. So I guess this guy has a few more days to respond before I just try to get my money back.

called them this morning and they said the reason was that they didnt get the color i wanted (which is bs cause i called on the 16th and had sent a number of emails) anyway i expressed my displeasure and they offered either ridiculous shipping or a refund. i went with the refund and ordered a shit ridiculous new autococker :diitb:

Yep, file a complaint with paypal...you'll eventually get your loot back. I had to do it once.

I ended up filing a complaint a couple days ago. I let it go for a day or two with still no response and then just went ahead and made it into a dispute. The guy has until Nov 9 to respond to paypal so I just get to wait for now.

Thanks man. It should be no problem since the dude still hasnt responded to anything. A few more days of no response and itll be a gimme and paypal should refund it.

Ive had smilier issues on a few occasions. Always got the goods or money. Only once was a real pain. The seller kept jerking me and Paypal around for over a month with claims of making good on the sale. Paypal pulled the plug on him and even banned his Ebay account. Then I got my money back.

Thats definitely re-assuring since Ive never had to deal with this. Like I said I dont think its going to be too much of a hassle once paypal looks at the facts, even if the guy finally responds to me or them. The only thing that sucks is with them giving him a 10 day window to respond and everything else itll be a couple weeks after when I initially paid until the time I get my money back.

Yeah. Id obviously rather have the shoes but oh well. Its not like I dont have any other ones, so Im really in no hurry. Ill either finally get those or buy some others once the money comes back.

Paypal is great...the only thing that sucks is the long wait. But, like jeeps is saying, it will work out.

No doubt. Im just glad I set one up a while back. I did my first couple ebay purchases with money orders, in which case Id probably be screwed by now.

Same here. I use mine for any kind of online shopping these days. Safe and easy is hard to beat.

File a complaint with paypal they insure you up to 1000$ if i remember correctly (good luck seeing that money within the next 5 months though)

Im hoping thats not the case and I highly doubt it will be. The guy still has yet to respond and the dispute was filed last week.
