so we live in a neighborhood that has a baseball diamond and soccer field.

a team as been playing on the diamond and leaving garbage and such and they are not authorized to play. and i don't think any kids actually live in our neighborhood.

recently had a HOA meeting and they are going to put a sign up, "so-n-so residents ONLY"

this past weekend, neighbor noticed the team and called the cops, cop came and told him that it was "public property" and that anybody could come and play as long as there was no gate or lock.

thoughts?

You walk up to them and ask them if they live in this neighborhood, if they have a coach, ask the coach.

Also call your HOA president to send out something to the neighborhood about it.

You'll have to look at your local laws to determine the answers to your questions. I'm pretty sure they can play as long as theres not any no tresspassing signs on the property.

That's why you go to the property owner to have something posted saying only neighborhood kids are allowed to use it.

If it is public property, it is as much their right to use it as it is yours.

Find out who owns the land.

If it is the neighborhood and the other McMansion owners want to keep the riff raff out, put up a fence, with a lock.

If not, learn to deal with it and quit acting like an 80 year old in a retirement community.

I agree that this would help with legal stuff, but then how do you enforce it? If it's a big enough neighborhood, no one is going to know if you actually live in that house just down the road or not.

A fence and sign will be enough to keep the "honest" kids out, but the ones who don't care, will still show up.

How do you know it's even the neighborhoods property? Do some research on the property owner, hell I even provided a link to help you find out shit...

A church tried this shit with me with a property they had no legal claim to because it was right next to their church. They put up booby traps to keep me off. I kept going back. Fuckers about took my head off...

These fuckers were rather creepy. More so than any southern baptist I have met here. I don't think they were any major denomination, just a splinter group. The church was designed like a southern plantation. I would leave my apartment at 5:30am on tuesdays and the parking lot would be packed. The people I talked to from it seemed nice, but when you went inside the church it was really fucking creepy lookin in there.

Find out who the owner of the property is actually listed as, if you want any sort of claim to it, you need to know who actually owns it and not it's right next to our stuff.... Saying it's right next to our stuff to a judge or cop is fucking retarded when you try to assert a legal claim to it... Seriously you sound like a cranky 89 year old woman who rants about kids and has no argument in logical or legal thought.

I don't know the lay out of your 'hood but just because you have a sign at the entrance and monthly dues doesn't mean that nobody else is allowed without your permission.

Want to have the kids in the area screened? Buy in a gated community.

Want to keep out those you deem not worthy? Put up a lock, only the neighbors get a key.

Otherwise, let kids be kids.

Be glad they are playing ball and not vandalizing the neighborhood foreclosures.

no, that's normal for churches, this was outside the realm of normality for churches. They had big murals that made you feel like they were advertising some kind of powerbar that would give you superhuman strength. Almost buddy jesus type advertising, but much more creepy.

I wish I took pics of it.

The discouragement of dating and the encouragement of courtship. This one really freaks people out.
The practice of church discipline. It’s in the Bible and Cornerstone does not ignore it.
The “near mandate” of a husband to romantically pursue and serve his wife. The only dating that the church encourages is within the bonds of marriage…a husband “dating” his wife, and believe me it is one of the best ways to protect and serve your marriage.
College students that are selflessly serving the church. VFC is different from the most student groups…and I am sure that other college students think they are weird.
Women teach and train other women in modesty. This is definitely foolishness from a worldly perspective.
Celebrating the God designed roles of men and women. The church realizes that men and women are different…designed for different roles and tasks and they aren’t afraid to teach and preach that.
Sincerity. The people of that church genuinely love each other. And I am not saying they like going to church on Sundays to see or be seen. I am saying that they get involved in other members’ lives. The moms get together for play dates with the kids, the college kids serve other families, men meet for accountability, and the care group leaders “get up in your business”…all in order to serve and encourage one another.

Again, find out who is actually is the property owner. The property owner will either be the developer of the subdivision or the HOA, if it is indeed the neighborhood property. Contact your HOA or developer and ask them to contact the authorities.

It's not your property, so you can't do shit, you need others to do it for you.

It wasn't a baseball field, it was some woods that some land baron lawyer in knoxville owned that was adjacent to their property. They didn't like me riding my 50 with it's loud ass pipe riding around on it. I didn't do it during their services, mostly saturdays, so they put up a wire about 4 foot off the ground that had a clear rubber coating on it that was very hard to see at 10 feet. When I came barreling through on my 50, I got clotheslined to the ground. Luckily, I was wearing my helmet that day and just ended up with a few stitches from the rash and a minor concussion. Needless to say after that, the times I chose to ride my fiddy were more scheduled and the noise I made was far greater than needed. I thought about pursuing it legally but figure fighting a church or lawyer would be hard with no proof of who put up the wire. a few weeks later a big concrete blocking device with a huge no trespassing sign went up.

Screw the lawyer, I'd try to find out who put that wire up, and beat the HOLY fuck out of him. Shit like that calls for some sort of destructive and childish revenge.

Ok, that was just weird!!

Racer X, depending on the laws in your area, and what governs private and public property, unless you have the owner call or you ARE the owner, typically LE cant do anything. It requires owner action and some type of announcement or sign stating no trespassing before LE can do anything.

I was the vice president of my HOA for a year. I got out of it because it was ridiculous. I had no idea adults could act in such a childish manner.

Ed, as an HOA guy *and* someone who designs subdivisions, let me offer this.

Any lots or common areas not purchased by a builder or homeowner, until such time that the occupancy requirement in the bylaws of the HOA are met, belongs to the developer. Period. He still owns that land and pays taxes on it.

Once the occupancy requirement is met, typically 75%, then the common areas and the HOA transfer to the property owners.

We had a similar problem with kids coming into the neighborhood to play on a playground we built. We didn't have a problem with it until they started leaving trash and vandalizing the equipment. Common courtesy woulda went a long way.

We called the police. I knew that wouldn't help, but the other members insisted. Their reply was that the park was public property because the community wasn't gated, and we couldn't keep the troublemakers off of the property unless we witnessed the vandalism. At that point, we could call the police, file charges, etc.

One kid had scratched her name into the equipment. Just so turns out she had a rather unique name, and someone on the board knew her parents. She was called out on it, had to come repair the equipment (her parents did actually), and she was told that she was not allowed at the park again.

Basically, unless you witness them causing damage and can call the police in a timely fashion, or put a gate up, it's one of many headaches you will deal with in being a part of a Homeowner's Association.

Yes, they would be trespassing, but you know what the charge is for trespassing? It's a misdemeanor with a small fine, at least here.

If it's gated, then it's a private community, and you have many more rights as far as what is and is not allowed, but that brings problems of it's own. The biggest one being road maintenance. The minute you put up a gate, the city can legally absolve itself of any responsibility to maintain your roads.

Not sure how many lane feet of roads you have, but in 20 years, repairs on that can add up in a hurry.

why don't you just approach these kids, ask them to start a team and play agains your HOA kids???? If they have some kind of ownership (clean the place up together before you start the game) they may respect it better?

I was stuck in Fort Pierce, Florida, for a few months, while the boat I crewed on was geting re-painted. The guy that owned the boat subletted a townhouse at an HOA controlled subdivision.

After a few weeks I got bored, so I bought a dual-sport to pass the time. The fuckwad HOA guy came to my unit and gave me shit about parking a motorcycle in MY parking space. I laughed when he told me I had to park it behind the fence where the dumpster was, and I asked him if his wife was parked there too.

Things went down hill from there.
