Fort Bend Sheriff’s Department sued after deadly high-speed chase

The Fort Bend Sheriff’s Department is being sued over claims one of its deputies carelessly embarked on a high-speed chase that resulted in the death of a motorcycle driver and his passenger.

Rebecca Tate and others, on behalf of the deceased San Juanita Hidalgo, filed a lawsuit on March 2 in Harris County District Court against the Fort Bend County Sheriff’s Department, citing negligence.

Tate says on June 16, 2011, Hidalgo died in a motorcycle accident on the Sam Houston Tollway. According to the brief, Hidalgo was a passenger on the motorcycle when a Fort Bend Deputy pulled the driver over for a minor traffic violation.

The suit alleges the driver of the bike sped away during the traffic stop and the deputy gave chase, driving at least 100 miles per hour to catch up. The motorcycle crashed into another vehicle and immediately killed the driver. Hidalgo died later that day.

Tate is seeking damages and court costs. She is being represented in the case by Houston attorney Mark Bankston.

driver of bike had active warrant in Ft Bend for DWI also.

Yeah, this definitely needs thrown out. The cop didn't MAKE the guy run. If the rider of the motorcycle survived but the passenger didn't, then the rider of the motorcycle should be sued, not the police. Even if the rider also died, the police still should not be sued because it wasn't their fault.

Rider at the controls is an idiot. Passenger could have jumped off as soon as the bike took off.

We'll If it's at a house because the moron thinks he "got away", I would think everyone in the house. I doubt most would not just dump the bike in a lot after doing all the hard work of stealing it.
