To echo wildchild's post, you are equating fighting harder with a certainty of winning the suit. That is far from reality. It usually isn't a judge determining the merits of the case, it is a jury made up of people who have much more in common with the plaintiff. There is also a view, which I personally believe has been growing for a long time, that money awarded in malpractice suits is "free" money since it comes from rich insurance companies, rich hospitals, and rich doctors. It doesn't help that plaintiffs typically sue for so much that a loss can severely impact defendant companies.

My wife's cousin used to represent doctors in malpractice suits but after many years of doing this he found that there are some fucked up doctors and now owns his own law firm representing patients. Not only is it more lucrative for him, it also gives him a feeling of justice when he wins a case for his clients. Apparently getting a judgment in favor of the defendant is less rewarding than winning a judgment for the plaintiff. Oh and his wife who is also an attorney is a degreed RN so it gives them a little insight to the medical profession aside form his previous experience as defendant council. He does have morals though and won't take bullshit cases...at least that's what he says.

When you work for the defense you get paid hourly. When you work for the plaintiff you get a percentage of the judgment (typically between 33-40%), but only if you win. If you want to see lucrative work for plaintiff's attorneys take a look at the tobacco settlement from 1998. There were, and still are, billions paid out to plaintiff's firms that "assisted" the state attorneys general in bringing the case against "big tobacco".

You always hear that 'possession is 9/10ths of the law', but the fact is, it's perception that is really 9/10ths of the law. (at least in reference to how the court system rules)

They already do, I cant count how many time I have been told wait till my lawyer hears about this. A few I called em on it I am like you live in th eghetto and amre milking medicaid but you have your own lawyer

Most lawyers laugh at these guys because they know they wont get paid fo rsuch petty stuff its not worth their time. We were surprised they took this case as far as they did but was nice to know they didnt get all that much and I am sure after the lawyers took their cut I doubt she had enough to get a BMW
